Auction Terms and Conditions

General Information

The Automobilia Auction is conducted by the Automobilia Collectors Expo (“ACE”). By participating in the auction, you agree to comply with these Terms and Conditions. These rules apply to all bidders, consignors, and attendees. References to “ACE” in this document refer to Automobilia Collectors Expo as the auction organizer.

Bidding Rules

  • All bidders must register prior to the auction and provide valid identification.
  • Bids may be placed in person, online (if applicable), or via an authorized representative.
  • The highest bid accepted by the auctioneer will be deemed the winning bid. All sales are final.
  • Payment for winning bids must be completed within 24 hours of the auction’s conclusion.

Consignment Rules

  • All items consigned must be pre-approved by the auction team.
  • Consignors must provide accurate descriptions, photographs, and any relevant documentation for their items.
  • A reserve price may be set for each item upon mutual agreement.
  • The auction house reserves the right to reject or withdraw items at its discretion.

Payments and Fees

  • Buyer’s Premium: A buyer’s premium of 20% will be added to the final hammer price. All sales are final.
  • Seller’s Commission: The seller/consignment commission is 15% and is only charged if the lot is sold.
  • Payment Deadline: Payment in full is due within 24 hours of the auction’s conclusion unless otherwise agreed in writing by ACE.
  • Accepted Methods & Surcharges: We accept cash, wire/bank transfer, and major credit/debit cards. A 4% surcharge applies to card transactions; a $100 administrative fee applies to wire transfers; and a $100 fee applies to any returned/NSF payment. Funds must clear before any lot is released.
  • Sales Tax: Applicable California sales tax is charged on the invoice (hammer price + buyer’s premium) unless a valid exemption applies (e.g., accepted resale certificate). The applicable rate is determined by the delivery/collection location and is subject to change. Purchases collected in Seaside, CA are taxed at the rate in effect at the time of sale.
  • U.S. Tax Forms (Consignor Settlements): To comply with U.S. tax requirements, ACE requires a completed IRS Form W-9 from any U.S. payee before issuing settlement payments when total payments to that payee will be $600 or more in a calendar year. If a valid taxpayer identification number is not provided, ACE may apply backup withholding as required by law until proper documentation is received. For non-U.S. payees, the appropriate IRS Form W-8 is required.
  • Consignor Settlements: Consignors are paid within 14 business days after ACE receives irrevocably cleared funds from the buyer, less applicable commissions/fees and any agreed charges (e.g., shipping, handling, storage).

Disputes and Liability

  • Buyer Default / Fraudulent or Reversed Payment: If a buyer’s payment is dishonored, reversed, charged back, fails to clear, or is determined by ACE in good faith to be fraudulent, ACE may, in its sole discretion, declare the sale null and void, mark the lot “Not Sold,” and no seller’s commission or lot fees will be charged to the consignor. ACE may reoffer the lot at a future sale or return it to the consignor.
  • Release of Property: Title and possession do not transfer and lots are not released until ACE receives irrevocably cleared funds.
  • Auctioneer’s Decision: In the event of a bidding dispute, the auctioneer’s decision is final.
  • Limitation of Liability: To the fullest extent permitted by law, ACE’s liability to any bidder, buyer, or consignor is limited to the amount of fees actually paid to ACE for the specific lot at issue; ACE is not liable for indirect, incidental, or consequential damages.
  • Governing Law & Venue: These Terms are governed by the laws of the State of California. Venue for any permitted action shall be Monterey County, California.

Release, Pickup & Storage

Purchases should be collected from the sale site by 3:00 PM on the day after the auction unless otherwise posted. Uncollected lots may incur a handling fee and daily storage charges. Lots may be transferred to ACE’s off-site facility at the buyer’s risk and expense.

Condition of Lots

All lots are offered and sold “AS IS, WHERE IS” without warranties of any kind. Descriptions, measurements, condition statements, and images are provided for guidance only and are opinions, not statements of fact. Buyers are responsible for inspection during preview and before bidding.
