Auction Terms & Conditions

The Live Automobilia Auction at the Automobilia Collectors Expo (ACE) is conducted under the following Terms and Conditions.

By registering, bidding, consigning, or attending, all participants agree to comply with these terms to ensure a fair and professional auction environment.

01. General Information

The Automobilia Auction is conducted by the Automobilia Collectors Expo (“ACE”). These Terms apply to all bidders, buyers, consignors, and attendees. References to ACE refer to the auction organizer.

02. Bidding Rules

  • Registration: All bidders must register prior to the auction and provide valid government-issued identification.
  • Bidding Methods: Bids may be placed in person, online if available, or through an authorized representative approved by ACE in advance.
  • Paddle Responsibility: The registered bidder is fully responsible for all bids placed under their assigned paddle number.
  • Acceptance: The highest bid accepted by the auctioneer will be deemed the winning bid. All sales are final.
  • Auctioneer Authority: The auctioneer reserves the right to reject any bid, resolve disputes, or withdraw any lot at their sole discretion.
  • Condition: All lots are sold “AS IS, WHERE IS”. Images and condition statements are opinions for guidance only; buyers are responsible for inspecting items during preview.

Payments & Fees

Buyer’s Premium

20% added to the final hammer price of each lot.

Seller’s Commission

15% charged only if the lot is successfully sold.

Payment Deadline: Full payment is due within 24 hours of the conclusion of the auction.

Accepted Methods: Cash, wire/bank transfer, and major credit cards. A 4% surcharge applies to card transactions; $100 fee for wire transfers or returned payments.

Sales Tax: Applicable California sales tax is charged on the total invoice (Hammer Price + Premium) unless a valid resale certificate is provided.

Settlements: Consignors are paid within 14 business days after ACE receives cleared funds from the buyer, less applicable fees.

04. Release, Pickup & Storage

Pickup Deadline

Purchases must be collected by 3:00 PM on the day after the auction, unless otherwise announced.

Storage Fees

Uncollected lots incur handling fees and daily storage charges. Lots may be moved off-site at the buyer's risk.

05. Liability & Disputes

  • Title: Ownership does not transfer until ACE has received cleared funds in full.
  • Finality: In the event of any dispute, the auctioneer’s decision is final and binding.
  • Limitation: ACE’s liability is limited to the amount of fees actually paid for the specific lot at issue.
  • Risk: All participants attend at their own risk. ACE is not responsible for injury or loss to persons or property.

06. Governing Law & Venue

These Terms are governed by the laws of the State of California. Exclusive venue for any legal action shall lie in Monterey County, California.

By participating in the auction, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
